The state government’s opposition to governor HR Bhardwaj is threatening to precipitate a constitutional crisis in the state with the ruling party on Thursday deciding to knock the doors of Rashtrapathi Bhavan with a demand to recall Bhardwaj. The governor has refused to accept the state’s recommendation to appoint Justice SR Bannurmath as the Lok Ayukta.

The BJP legislature party, which met on Thursday, decided to send a delegation to president Pratibha Devisingh Patil to complain against Bhardwaj.

“The governor has joined hands with the opposition to conspire against the state government. We will bring his anti-constitutional conduct to the president’s notice. The date of the meeting would be finalised soon,” said water resources minister Basavaraj Bommai.

The legislature party meeting adopted a resolution, stating that: “Justice SR Bannurmath should be appointed as Lok Ayukta in accordance with the recommendation of the state government or the governor should tender his resignation.”

It is mandatory for the governor to accept the state’s recommendation to appoint the Lokayukta. The chief minister had followed procedures that previous chief ministers followed while finalising his choice of Justice Bannurmath to head the anti-corruption agency. The governor has no powers to reject the state government’s recommendation. The governor’s pressure tactics against the state government in this regard is illegal. The governor should quit if he is not ready to accept the state government’s decision,” added Bommai.

BJP leaders have questioned Bhardwaj’s rationale in opposing the government’s choice by pointing out that Bhardwaj, while serving as the Union law minister, recommended Bannurmath’s name as Chief Justice of the Kerala high court. “Why is the governor raising an objection now,” said BJP legislators.

Rejecting the allegation that Justice Bannurmath owns an illegal site in Bangalore, the note circulated in the BJP meeting said former Lokayukta Justice N Venkatachala, State Human Rights Commission chairman SR Naik, Supreme Court judge Ravindra Naik and many others, too, had obtained sites despite owning houses in Bangalore.

“Is it fair on part of the governor to oppose the choice of Justice Bannurmath despite being aware of his efficiency and unblemished record. It appears to be part of a conspiracy to appoint Justice N Santosh Hegde as the Lokayukta again,” said the note.
